1. Definitions

• Client: An individual or legal entity contracting the web development services offered by MBM DIGITAL HUB.
• Services: Development and delivery of websites according to the specifications agreed upon between the Client and MBM DIGITAL HUB.

2. Scope of Services

Package Landing Page

• We will design and develop a landing page website that includes basic elements such as Hero, Features, Contact Forms, FAQ, and Services.
• The scope of work and deliverables will be as defined and agreed upon during the consultation phase.
• Additional customization beyond the defined scope may incur extra charges, which will be communicated and agreed upon before implementation.

Package SaaS Website

• Includes all elements of the Package Landing Page.
• Integration of an authentication system, payment gateway, custom backend logic tailored to client requirements, and database setup.
• The project scope and specific functionalities will be detailed in a project proposal and agreed upon before commencement.
• Ongoing maintenance and support options will be discussed separately based on client needs.

Analytics Dashboard Google Ads

• Enhance your Google Ads campaigns with our Analytics Dashboard subscription.
• Gain access to advanced metrics, in-depth analysis, actionable insights, and improvement recommendations for effective campaign optimization.
• The subscription fee is $100.00 USD per month, billed monthly in advance.
• Subscription fees are non-refundable.

Package Custom Component

• Designed for custom integration modules not included in Landing Page or SaaS Website packages.
• Includes creation and integration of specific features such as image galleries, meeting schedulers, or other customized functionalities.
• Pricing and project scope will be discussed and agreed upon based on client requirements.
• Additional content creation, specific functionalities development, consulting, technical implementation, and rigorous testing are part of this package.

Privacy Policy

This privacy policy describes how MBM DIGITAL HUB collects, uses, and shares personal information of users of its services.

• Information Collected: MBM DIGITAL HUB may collect personal information, such as name, email address, etc., with the explicit consent of the User during the registration or usage of the service.

Benefits for the Client:

• Scalability: Our technology stack ensures your application can scale seamlessly as your user base grows.
• Performance: Leveraging AWS and Vercel, we guarantee optimized and reliable performance.
• Flexibility: MongoDB allows flexible data handling and schemeless database management.
• Security: AWS offers robust security features to protect your data and applications against potential threats.

Client Obligations

• Provide complete and accurate information necessary for website development.
• Notify of any changes or modification requests during the development process.

Changes and Modifications

• Two rounds of free revisions are offered.
• Any additional changes required by the Client will be considered as modifications and subject to an additional fee of $150 per requested change.
• MBM DIGITAL HUB will notify the Client of any additional costs before proceeding with requested modifications.

Intellectual Property

• All intellectual property rights related to the developed website belong to the Client upon completion and full payment of the project.
• MBM DIGITAL HUB reserves the right to showcase the project in its portfolio and promotional materials unless otherwise agreed with the Client.

Payments and Invoicing

Payments Initiation

• Payments will be initiated through the MBM DIGITAL HUB website via the integrated payment gateway.
• Payments for our services are securely processed through the MBM DIGITAL HUB website using an integrated payment gateway. This ensures that all transactions are conducted safely and efficiently online.

Payment Methods Accepted

• We accept debit card, credit card, bank transfer, Apple Pay, and Google Pay.
• You can choose to make payments using debit cards, credit cards, bank transfers, Apple Pay, or Google Pay. Our flexible payment options cater to your convenience and security preferences.

Security Measures

• Your payments are secure with us. We prioritize the security of your transactions. Our integrated payment gateway encrypts your payment information to protect it from unauthorized access. You can rest assured that your financial data is handled with the utmost care.

Invoice Generation

• Invoices will be generated automatically for each transaction. Upon successful payment, an invoice detailing the transaction will be generated automatically. You will receive a copy of the invoice via email for your records.

Payment Terms

• Payments are due as agreed upon between the parties and subject to the selected service terms. Payment terms, including amounts and frequencies, will be determined by the service package selected by the client. These terms will be clearly communicated and agreed upon before payment initiation.

Legal Compliance

• All payment methods and practices adhere to applicable legal and regulatory standards. We comply with industry regulations and guidelines to ensure transparency, fairness, and security in all payment transactions.

Cancellation Policy

Web development service:

• Once the client has made a payment after viewing their initial website draft, no refunds will be provided. This policy ensures that clients commit to the project after the initial draft, recognizing the work already invested by our team.

Google Ads platform:

• Users are granted a free 7-day trial period for our monthly subscription service, which provides Google Ads platform to enhance campaign performance. If the user continues to use the service beyond this trial period, no refunds will be issued. This trial period allows users to evaluate the service and ensure it meets their needs before committing to a paid subscription.

Liability

We shall not be held responsible for any misuse of our platform by users. Refunds will not be issued for cancellations of our Google Ads platform service after the conclusion of the free trial period. Additionally, we do not assume liability for any financial losses incurred through the utilization of our platform.

Regarding our web development services, once the initial draft has been presented, refunds will not be provided.

Applicable Law and Jurisdiction

These terms and conditions shall be governed and interpreted in accordance with the laws of EEUU. Any dispute arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of EEUU.

Modifications to Terms and Conditions

MBM DIGITAL HUB reserves the right to modify these terms and conditions at any time. Modifications will become effective immediately upon posting on the MBM DIGITAL HUB website.
